Who’s Liable for Your Revel Electric Moped Accident in Miami?

Revel electric mopeds can be seen on the streets of Miami more frequently now that e-mopeds are available for rent in a designated area of Miami. As of January 2020, there are 750 rental mopeds available in Miami, and the company has about 30 employees across the city who provide service to the customers.

But who is liable for a Revel moped accident in Miami? Does insurance cover your personal injury in an accident while riding a Revel e-moped?

Revel Electric Mopeds Are Available for Rent in Miami

Miami is not the only city that offers rental e-mopeds provided by Revel. Other locations where you can rent an electric moped include Queens and Brooklyn (New York), Austin (Texas), Oakland (California), and Washington, DC. Revel e-mopeds are manufactured by NIU Technologies, which is based in China.

However, Revel e-mopeds are not available everywhere in Miami. The neighborhoods where people can rent a Revel electric moped include:

  • Allapattah
  • Liberty City
  • Wynwood
  • Little Havana
  • Edgewater
  • Overtown
  • Coral Way
  • Model City
  • Little Haiti
  • Brickell
  • Coconut Grove
  • Downtown Miami

Note: Miami Beach is excluded from Revel’s service area. Also, Revel e-moped riders are not allowed to drive the mopeds on highways or attempt to cross major bridges. Those who use the e-mopeds outside the service area could be accused of failing to comply with the terms of the Revel agreement, which could void any possible insurance coverage in the event of an e-moped accident.

Can You Get Compensated After a Revel E-Moped Accident in Miami?

Yes, you may be able to obtain compensation after a Revel electric moped accident in Miami, but it depends on a variety of factors.

One such factor is whether the moped driver complied with all the terms, policies, and rules of Revel. If there is a violation, Revel is likely to deny any personal injury claims after an e-moped accident, which could lead to insurance coverage disputes.

Currently, Florida law does not have any insurance requirements for electric mopeds, though such conditions exist for motorcycles to provide compensation in the event of motorcycle accidents.

Revel vowed to provide bodily insurance coverage for its e-moped drivers in Florida. According to Revel’s website, the company will provide limits of:

  • $50,000 per accident
  • $25,000 per person
  • $10,000 for property damage caused by the Revel moped driver

According to the rental agreement that every Revel moped driver must sign prior to using the company’s services, the electric moped driver’s personal auto insurance is always primary in the event of accidents.

In other words, the moped driver’s insurance, if he/she has any, will be the first source of recovery. However, there is no guarantee that the e-moped driver’s insurance will approve any claims arising from the use of a rental electric moped in Miami.

If the e-moped driver’s insurance policy declines coverage, the injured party will have to file a claim against the Revel insurance policy.
